Terms of Service (Leadburnr)

These Terms of Service (“Terms”) govern your access to and use of the Leadburnr website and software platform (the “Service”). “Leadburnr,” “we,” “us,” or “our” refers to the individual operator of Leadburnr. “You” or “User” refers to any person or entity using the Service.
By accessing or using the Service, you agree to these Terms. If you do not agree, do not use the Service.

Leadburnr helps users discover and qualify potential business leads. The Service may provide business information, website-derived signals, and qualification metrics. Leadburnr does not guarantee that any lead will convert to a customer, that any outreach will be successful, or that any information is complete or accurate.2) Eligibility and Account Registration
You must be at least 18 years old (or the age of majority in your jurisdiction) to use the Service.
You agree to provide accurate information when creating an account and to keep your account information up to date. You are responsible for maintaining the confidentiality of your login credentials and for all activity that occurs under your account.3) Acceptable Use
You agree not to misuse the Service. You will not:use the Service for unlawful, harmful, or fraudulent purposesviolate any applicable laws or regulations (including privacy, marketing, and anti-spam laws)attempt to gain unauthorized access to the Service or related systemsinterfere with or disrupt the Service (including by overloading, scraping the Service itself, or attempting to bypass limits)resell, sublicense, or provide the Service to third parties unless explicitly permitted by Leadburnr
You are solely responsible for how you contact and communicate with any leads you obtain using the Service.4) Lead Data and Third-Party Sources
Leadburnr may compile or process business information and website-derived signals from publicly available sources and/or third-party data sources. Leadburnr does not control those sources and cannot guarantee their accuracy, availability, completeness, or legality for your specific use.
You acknowledge that:lead data may be incomplete, outdated, or inaccuratewebsites and business listings may change at any timesome sites may block automated access, resulting in missing dataavailability of third-party sources may change without notice5) User Responsibilities (Outreach and Compliance)
If you use lead information to contact businesses, you agree that you are responsible for complying with all applicable laws and regulations, including (where applicable) anti-spam, privacy, and marketing rules (e.g., CAN-SPAM, GDPR/UK GDPR).
Leadburnr is not responsible for your outreach practices or any consequences arising from them.6) Plans, Billing, and Payments
Paid subscriptions are billed in advance and processed through a third-party payment processor (e.g., Stripe). By purchasing a subscription, you authorize Leadburnr (through its payment processor) to charge your payment method according to your selected plan.
You are responsible for any applicable taxes.
If payment fails, your access may be suspended until payment is resolved.7) No Refunds
All sales are final. Leadburnr does not offer refunds, including for partial months, unused time, or unused usage limits/credits (if applicable), except where required by law.8) Cancellation and Termination
Cancellation: You may cancel your subscription at any time. Unless stated otherwise at checkout, cancellation takes effect at the end of the current billing period. You will continue to have access until the end of the period you have paid for.
Termination by Leadburnr: We may suspend or terminate your access if we reasonably believe you violated these Terms, misused the Service, or created risk or legal exposure for Leadburnr or others.
Effect of termination: Your right to use the Service ends immediately upon termination. We may delete or restrict access to your account data, subject to applicable law and our retention practices.9) Intellectual Property
The Service, including all software, design, branding, and content, is owned by Leadburnr and protected by intellectual property laws. You receive a limited, non-exclusive, non-transferable, revocable license to use the Service for your internal business purposes, subject to these Terms.
You may not copy, modify, distribute, sell, lease, reverse engineer, or attempt to extract source code from the Service except to the extent permitted by law.10) Feedback
If you submit feedback, suggestions, or ideas, you grant Leadburnr a non-exclusive, worldwide, royalty-free right to use and incorporate them into the Service without compensation.11) Disclaimers
THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE.” LEADBURNR DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.
Leadburnr does not guarantee:accuracy, completeness, or reliability of lead datathat the Service will be uninterrupted, secure, or error-freeany business outcomes, including replies, booked calls, sales, or revenue12) Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, LEADBURNR WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF PROFITS, REVENUE, DATA, OR GOODWILL, ARISING FROM OR RELATED TO YOUR USE OF THE SERVICE.
TO THE MAXIMUM EXTENT PERMITTED BY LAW, LEADBURNR’S TOTAL LIABILITY FOR ANY CLAIM ARISING OUT OF OR RELATED TO THE SERVICE WILL NOT EXCEED THE AMOUNT YOU PAID TO LEADBURNR IN THE 30 DAYS BEFORE THE EVENT GIVING RISE TO THE CLAIM (OR $50 IF YOU HAVE NOT PAID ANY AMOUNT).
Some jurisdictions do not allow certain limitations, so some of the above may not apply to you.13) Indemnification
You agree to indemnify and hold harmless Leadburnr from and against any claims, liabilities, damages, losses, and expenses (including reasonable attorney’s fees) arising from or related to:your use of the Serviceyour outreach activities or communicationsyour violation of these Terms or applicable laws14) Changes to the Service and Terms
We may update the Service or these Terms from time to time. If we make material changes, we may provide notice through the Service or by email. Continued use of the Service after changes take effect means you accept the updated Terms.15) Governing Law and Venue
These Terms are governed by the laws of the State of New Mexico, without regard to conflict of law principles.
You agree that any dispute arising out of or relating to these Terms or the Service will be brought exclusively in the state or federal courts located in New Mexico, and you consent to personal jurisdiction in those courts.16) Contact
